At least $12 million of the $60 million fine Penn State was to pay to the NCAA is going back to Penn State in the form of an endowment. Not just keep it in the state.

I do not post updates on The Penn State Scandal until there are significant details or developments and in my judgment that has not happen as much and much is just being rehashed as delays continue to be part of the Defense Team tactics.

However, when another Poster will put up a Penn State Scandal Subject, I will add some details that are being sorted out, but still long from being decided. Here are some of those smaller details updates.

1. The PA-NCAA Settlement included paying the Attorney Fees of the NCAA of $1.3 million. One reason why the NCAA settled with the State and restored Vacated Wins. But refused to remove the 2 Years of sanctions that did occur. Lubrano said they should have looked closer to the Settlement before approving NCAA's $1.3 million in legal fees from Corman-PA v NCAA-PSU.

2. Judge Hoover has put on hold the Spanier, Curley, and Schultz Criminal Cases until all their Appeals on his rulings are heard, dismissed, or will be ruled on after Trial. This can be become complicated since the Pennsylvania Supreme Court has to fill Vacant Seats and not until after November.

3. Developments surrounding AG Kane whose Office will put on the Criminal Trials are still under review and whether AG Kane will be able to survive staying in office or charged with leaking Grand Jury Info? In addition, so far no continued fallout on all the Judges that were part of the Porn Emails with AG Corbett's and Kelly Prosecutors and there was far more than just one or two? This has been hushed up by both parties not looking forward to replacing many Judges should that happen? The Civil Trials of 3 Children Victims that did not settle is still continuing on Discovery Issues.

4. Still, no reporting or update on the Clery Act and Title IX Investigations, Reports, and Findings. These are outright violations of the Procedures and Time Lines for such public reporting, and nothing is being reported or submitted by anyone to force these to be made public.

Penn State supports Pepper Hamilton in brief filed in Paterno v. NCAA

Penn State filed a brief in Paterno v. NCAA today, saying it is "irresponsible and disingenuous for [the Paterno Estate] to claim that Penn State and Pepper Hamilton are somehow 'violating' a court order," according to court documents. A nominal defendant in Paterno v. NCAA, Penn State filed the brief in support of Pepper Hamilton, LLP in the ongoing battle over whether Pepper Hamilton must give documents to the Paterno Estate. Former FBI director Louis Freeh - who investigated Penn State's handling of the child sex abuse case involving former assistant football coach Jerry Sandusky - is a partner at Pepper Hamilton.

The brief is in response to a supplemental memorandum the Paterno Estate filed last week supporting their motion for enforcement of subpoenas against Pepper Hamilton, according to court documents. Penn State asserts the Paterno Estate's claims that Pepper Hamilton is violating discover obligations and defying a court order are illegitimate as neither Penn State nor Pepper Hamilton have been ordered to do anything by the court, according to the documents. According to the documents, the Paterno Estate's arguments rely on the presumption that the court has addressed and overruled the work product doctrine issue, under which Pepper Hamilton has objected to releasing documents. However, according to the documents, there has not yet been a ruling on the work product-doctrine question.

"Plaintiff's vitriolic accusations notwithstanding, Pepper Hamilton and Penn State have done nothing more than assert bona fide objections to producing materials they contend are privileged," the documents read, "and they have asserted those objections in procedurally proper ways." Penn State argues that court enforcement of the Paterno Estate's subpoenas would violate established case law upholding privilege while an appeal is pending, as it is for Pepper Hamilton. The Paterno Estate has been attempting to attain the documents in question since it initially filed a notice of its intent to subpoena Pepper Hamilton in February 2014.

In July 2013, Paterno family members, former Penn State Board of Trustees member Al Clemens and former assistant coaches Bill Kenney and Jay Paterno filed the civil suit against the NCAA to argue the legitimacy of the consent decree. The consent decree levied sanctions - including a $60 million fine, a four-year postseason bowl ban, a reduction of scholarships and the removal of more than 100 Penn State wins under late head football coach Joe Paterno - on Penn State in the wake of the Sandusky child sex abuse case. The bowl ban was rescinded in September, and the wins were returned in January when the consent decree was replaced with a new agreement upholding the $60 million fine and keeping it in Pennsylvania.

Sandusky was sentenced to 30 to 60 years in prison on 45 counts of child sex abuse.

The fight over a pending subpoena against Louis Freeh's law firm continues to heat up in Centre County Court.



In new court documents filed Thursday, attorneys for Penn State accuse lawyers for the estate of former university head football coach Joe Paterno of making "bald misstatements" and "vitriolic accusations" in the estate's ongoing lawsuit with the National Collegiate Athletic Association. Penn State argues that the plaintiffs in the lawsuit -- which includes the Paterno estate, former Penn State assistant football coaches Jay Paterno and William Kenney and former university trustee Al Clemens -- are purposefully stretching the truth in their fight to subpoena the law firm of Pepper Hamilton (which acquired Freeh’s law firm through a merger in 2012).


Although Pepper Hamilton is not a party to the lawsuit, the plaintiffs want to subpoena the firm for a slew of documents gathered during Freeh’s investigation of Penn State in the wake of the Jerry Sandusky child sex abuse scandal. The law firm has strongly opposed the proposed subpoena because it claims the documents are protected by the tools of attorney-client privilege and work-product doctrine -- and Penn State agrees. "Plaintiffs assertion that Pepper Hamilton is somehow 'brazenly continuing to violate its discovery obligations' and is 'defying' a court order in 'direct affront to' this court's 'authority' are palpably false," Thursday's court filing reads. "...Neither Pepper Hamilton nor Penn State have been ordered to produce documents for which they assert one or more privileges."

The Centre County Court of Common Pleas overturned Pepper Hamilton's objections to the subpoena last year, but the law firm is currently appealing that decision to the Pennsylvania Superior Court. Penn State's latest filing also points out that enforcing the subpoena would derail this appeal, which the university says is "in sharp contrast to well-established case law holding that a privilege should not be destroyed while a litigant's appeal is pending." The plaintiffs in the suit first filed their suit against the NCAA in May 2013. They argue that the NCAA overstepped its authority in the aftermath of the Sandusky child sex abuse scandal, ultimately decreasing the value of the Paterno estate and making it more difficult for Jay Paterno and Kenney to find work. Penn State was later added to the lawsuit by the court, but remains a "nominal" defendant and is less directly involved than the other parties.


Pepper Hamilton is entangled in the case because it acquired the law firm of Freeh, Sporkin and Sullivan in 2012. Freeh and his team of investigators were hired by Penn State in 2011 to determine what actions or inactions allowed the Sandusky scandal to unfold. The Freeh Report was released in 2012. It claimed that top Penn State administrators tried to cover up the Sandusky scandal and ultimately formed the basis for the NCAA's punitive sanctions against Penn State.

I predict people from old Second Mile will benefit.It almost seems like

money laundering in some twisted way that the $12 mill is not a penalty but instead a benefit to pay University employees from the fund instead of from their Department.

Kids certainly need help but couldn't the help come from 100 other deserving Colleges or Universities in Pennsylvania and not Penn State?

You know, if the NCAA so wasn't in a rush for a trophy, a rush to judgment, they could have really nailed PSU and connected all the dots and I am sure the findings would have been ugly, actually and possibly maybe so ugly that it would have ruined the institution, and honestly as much as we hate PSU, that would have been bad on so many levels.

I think they felt they made enough of a compelling argument, and presented it to PSU who accepted it knowing it could be far worse. That it was not a smack on the wrist, but a decent slap in the face. What the NCAA didn't expect is that there would be no such humility from the PSU folks, that they believed their Pope was infallible and that their own incompetency in other investigations would be used against them.

And all of a sudden, remarkably, the guilty were now the victims and the NCAA are the perps.

Captain, have you heard anything about the FBI and The Second Mile? There are rumors bubbling beneath the surface up here (nothing terribly concrete) that there is a separate investigation that may blow up yet. Given as the reason that everything with the "Gang of Three" is being bottlenecked.

There has been rumors the FBI and US Attorneys have been involved into an extensive investigation on Tom Corbett own Prosecutors and their relationship to State Senators and House Members on many of the investigations of the various way they went about investigating and allowing a careful selection of Corbett's political friends not being investigated and were not ever called before any Grand Juries such Bonusgate and Computergate?

They grew even bigger when AG Kane uncovered the Porn Emails that involved many Judges that some of those Judges ruled on investigations and maybe were compromised by the Prosecutors? This is the reason there are legs on the AG Kane Grand Jury Leaks charges and Former Chief Justice Castile had major problems with AG Kane as well known. Yet, there seems to be a MAD Agreement, Mutual Assured Destruction, if it continues but players have changes like Castille no longer being there.

Kind of relates to the Sandusky Investigation and Grand Juries where AG Corbett Prosecutors took their good old time in investigating Sandusky, pretty much ignored The second Mile AG Corbett Political Contributors, and said they found no evidence Paterno was not involved in any covers up, but Freeh did after findings emails that they thought were erased due to changing Computer Systems. (Very Similar To Allowing The Republican Caucus State Senators Allowed To Destroy To Change Their Computers And When It came To Calling Them Before A Grand Jury There Was No Evidence Left To Even call One State Senator Or Their Aides Before The Grand Jury.)????

Consequently, the allegation is and has been that Corbett's Fina carefully selected what House Members would be indicted but no State Senators and of course what Penn State Officials would be indicted but no Second Mile Corbett Campaign contributors and no Paterno?

This rumor really had legs when the entire the Grand Jury report was ready to go much earlier but carefully released into being delayed ONLY after Paterno won his 409th NCAA Breaking Record of Grambling's Eddie Robinson's 408 wins?

Moreover, the Sandusky Grand Jury Presentment Report was clearly leaked as well to certain Reporters and faxed illegally, but the Judge involved with these Grand Juries had a Corbett AG Prosecutor appointed to investigate his own Corbett's Prosecutors Colleagues who were the only ones in charge of the Grand Jury Reports and were the only ones that could have leaked it????

Yet, AG Kane right after she took over removed that Judge that appointed that Corbett Prosecutor Insider and nothing was ever heard about that Grand Jury Investigations into many Grand Jury Leaks that happen under Corbett's Frank Fina & his Investigators on DeNaples, Bonusgate, Computergate, and Sandusky? ..........Then came PSU Trustees appointing Louie Freeh to investigate what happen and found the Hidden Emails of Spanier, Schultz, Curley AND PATERNO plus found the Grand Jury Report itself had many errors of omissions and even worse including the wrong Year when McQueary saw the molestation that impacted on Statue of Limitations of the many charges?

This is why I have said Senator Corbin could come to regret his settlement with the NCAA someday should someone breaks the dam now being plugged with political fingers and braked by delays, by a few in the Pennsylvania Society that is the place that determines privately contributes to political candidates including State Judges campaigns and that appoint Federal Judges?

What rumor was that again on US Attorneys investigating the investigations that everybody just wants to go away ASAP now? And I just tangent mind you, tangent slightly touched these rumors with facts mixed up together cause only more confusion!!!!

In the Businesss Sector, I know for a fact that (Because I Was Involved In One Downsizing), Rumors are used to downsize corporations so the best ones are told to stay if they got worried (Smart Ones Adjust Fast) and only the dummies that still stayed were let go, as the in between left before that downsizing by listening to the rumors put out on purpose to ease the downsizing.

In Justice and Government sectors, rumors are used to confuse, delay distract, and misinform the public on areas where as information comes out on corruption that removes some in power as other replace them to gain that power and that is for the economic interests to take care of themselves like the Second Mile folks that used political donations for their own business interests and have the political clout and in some cases secrets to protect just that too!

Power deals with Power and cut deals too, and when it all comes out later it is becomes written history of political machinations necessary to survive from scandal to scandal as others keep prowling for power?

I have heard many rumors, but have seen more mystery remaining, that I cannot understand, except listening to my Father's advice, when you cannot understand something or it can't be explained to you, get the hell out of that room before you get hurt by something won't understand?

Something is going on I can't understand and that is all I know with certainty right now? I have not left the room yet and still reading and listening, but as time moves on, so is this scandal that has spawn many scandals unanticipated to date, and could bring even more, many holes are still be plugged!

In closing, this is one area I am in sympathy with the Blehars, Bagwells, and CULTure at Penn State, but their new Elected Trustees are after power at Penn State and many dealt with the power in the commonwealth before they were ousted and they have their own machinations to manipulate the very people seeking the full truth, in the name of loving Penn State, so they say????

Many good people and children hurt very much due to these Penn State Graduates, Alumni, and Fans. As well as, a few Prosecutors that were using State Computers on State Time on sending Porn while prosecuting others for using State Resources on State Time?

These Scandals allowed many bad people to just walk away without any accountability and the rest including the many Judges just trying to save their Pensions from further investigations.

It is no longer "Pay For Play" but "Pay & Pray"! The Appeal Process is where the bigger cover ups are actually happening and they are glad that is taking time so they can let the public forget. Judge Covey ruled against the NCAA and is now running for Supreme Court?

Meanwhile, in Happy Valley Penn State prior prowling for power predators see an opportunity to take over the University using the Penn State Scandal they help create as they escaped cover ups at Bonusgates, Computergate, and Second Mile, among friends and contributors and never thought a Democratic AG would ever be elected and are married to some Appeal Judges as well????

The "We Are...Nambla" slogan fits BWI and the Paterno supporters to a tee. Even the Nebraska board noted that BWI resembles a NAMBLA board in their excuses for the rape of children in an effort to justify St. Joe's inaction when being told that children were being raped on campus at PSU.
