There is an inferred provision in every contract that both parties shall deal with the other fairly and in good faith. It is called the covenant of good faith and fair dealing. The party obligated to perform personal services under that contract — in the case Capel — is obligated to use his or her best efforts to perform them adequately and to the best of his or her ability.

Watching the first 16 minutes of this travesty — as well as most of the games this season — leaves no doubt in my mind that Jeff Capel is in breach. Not only is he not utilizing his best efforts to prepare this team; he is expending no effort. The most common phrases I hear from the announcers are “uncontested” and “wide open” when VT takes a shot. There is no semblance of a defense. No effort was made to prepare this team for a team that lives and dies by the three. VT has made 11 straight mainly uncontested shots. Make that 12. Make that 13.

On the bench, Capel is a stone statue. He doesn’t care. He doesn't care about winning. He doesn’t care about recruiting. He doesn’t care about anything except collecting his pay.

Don’t let him collect another dollar. Fire him tomorrow morning. Terminate his contract for cause. There are lots of grounds for doing so, not just this pitiful job. He is shaming this University.
