412 Day

Working with Pitt to do what? Force them to use their whack trademark version instead of version currently used up until today? This whole situation is bogus. I get it if stole their variation of displaying 412. But, they didn't... So, don't get this.

There's nothing to get, they're acting in bad faith to promote their garbage brand.

That's their trademark, putting '412' on a helmet does not violate it. They cannot trademark the number 412, only a stylized version of it. Pitt should have called their bluff, but it probably wasn't worth the trouble from Pitt's perspective.

Their margins must be insane given the poor quality of their merchandise relative to the prices they charge. We're talking close to ASSC level in terms of disparity between price and quality. This is just another reason not to patronize them.

Agree Pitt should have called their bluff. Pitt shouldn’t let these clowns make a penny off them. The 412 on the helmet is not the same as their crap brand. For those of you with a 412 phone # you may want to check with these dopes before you make a call ;) smh

Pitt should put it in cathedral font, and trademark that themselves.

Agree

I just saw some thing similar in the drumming world where people can’t use the term “gospel chops”( slang term for specific drumming style ) and people doing YouTube videos discussing or giving lessons are sent cease and desist letters?

The term is slang and I don’t understand how anyone can claim ownership any more than they could for the terms rock or jazz or Drum n bass or hip hop...

It’s nuts

Anyway the helmet looks awesome

What a dumb business decision on their part. The response against them on Twitter has to have them realizing they goofed up big time.

I actually liked those shirts and was going to get one (or several)....but if they dont stand the efff down I’m not

You Trotskyites have to put yourselves in that situation. :D While i am not legalistic enough to know if mere numbers can be copyrighted, if 'the system' allows for even the gray area of possibility for it, and these turkeys had the sense to do it before someone else and make their livelihood from it, then 'the system' makes it possible to try to fight others using it in some money making way. It's just how it is. I can't blame them. However, court of public opinion also exists, and it is powerful, and it appears to be swayed against them on this, so theyre wise to make an amenable arrangement.

They make a lot of money off black and “Pittsburgh” gold and I’m sure they didn’t pay to use it. Also, did they pay for the right to the astroid (spelled correctly) in their 412 logo??

Numbers can't be trademarked (copyright doesn't apply here). A specific design that incorporates a number (i.e. a logo) can be trademarked, but only for that unique design. That's the key - it has to be unique. The number 412 is not unique, it's an area code that's existed since 1947. Ergo, Shop 412 could stop Pitt players from putting their awful "L tiny star 12" logo on their helmets, but they have no legal recourse whatsoever to stop them from wearing the number 412.

I suspect that Shop 412 were negotiating with Pitt to carry apparel and somebody involved in that process was an enormous imbecile and took exception to the 412 on the Pitt helmets. Ladies and gentlemen, this is why so many small businesses fail. The margin for error is so thin and it only takes one idiot to do something stupid like this to destroy the community goodwill that they rely on.

"U.S. Patent and Trademark Office records show that the Shop 412 logo became a registered trademark on Sept. 18, 2012. The digits “412” are also listed as a word mark belonging to Shop 412, meaning Shop 412 has trademark rights to the digits as plain text."

Read the comments after the article. It's obvious that someone from the shop has responded a bunch of times.
