Spanier seeks to have Sandusky-related conviction overturned

He was found criminally liable for his response to a 2001 report that former assistant football coach Sandusky had been seen sexually abusing a boy in a team shower. Spanier, who did not testify, has said the attack was characterized to him at the time as horseplay.

He is arguing a two-year statute of limitations applies and had expired by the time he was charged in 2012. The argument in court on Wednesday focused in part on a post-trial ruling by the judge that cited an exception to the two-year limit in cases where someone under 18 has been victimized by a sexual offense.

Under those circumstances, which expressly include the crime of child endangerment, charges may be brought until the victim turns 50.

Jurors in the Spanier case acquitted him of engaging in a course of conduct — a decision that Spanier’s lawyer argued should also affect how the statute of limitations applies. Jurors ruled that Spanier’s crime consisted of his acts in 2001, his lawyer argued, so the crime did not continue in subsequent years by a lack of action to protect children against Sandusky.

Spanier attorney Bruce Merenstein said the provision cited by Judge John Boccabella’s post-trial opinion defending the verdict had never before been raised, preventing the defense team from addressing it in a meaningful way.

“The time to do it was before trial,” Merenstein told a three-judge panel. “You simply cannot raise that exception after-the-fact.”

Spanier was acquitted of conspiracy and a second count of child endangerment. He was sentenced to two months in jail and two months of house arrest but remains free on bail pending appeal.

The university said Wednesday Spanier remains a tenured faculty member on administrative leave. Under a separation agreement, he was paid $600,000 annually for five years, payments that ended three months ago. His current salary, like that of most other Penn State faculty members, is not disclosed by the school.

At sentencing, Spanier told the judge he regretted he “did not intervene more forcefully.” Two of the top administrators under Spanier when he led Penn State, then-athletic director Tim Curley and then-vice president Gary Schultz, pleaded guilty to child endangerment and testified against Spanier.

Boccabella told all three defendants last year that they “ignored the opportunity to put an end to his crimes when they had a chance to do so” and that he was “appalled that the common sense to make a phone call did not occur,” a transgression Boccabella said “sort of robs my faith of who we are as adults and where we are going.”

In a February 2001 email, Spanier told Curley and Schultz he approved a proposed response to the 2001 complaint that involved telling Sandusky he should seek professional help and could not to bring children into university facilities. The administrators did not plan to inform police or child-welfare authorities.

“The only downside for us is if the message isn’t heard and acted upon and then we become vulnerable for not having reported it,” Spanier wrote. “The approach you outline is humane and a reasonable way to proceed.”

Boccabella’s post-trial opinion noted that at least four young boys were sexually abused by Sandusky after 2001.

Sandusky was convicted in 2012 of 45 counts of child sexual abuse, including for the incident in the shower that graduate assistant Mike McQueary reported to Spanier’s lieutenants. He is pursuing appeals of his own while serving 30 to 60 years.

The scandal has cost the university more than a quarter-billion dollars, including payouts to dozens of people who say they were abused by Sandusky as boys.
 
All these shenanigans that have recently happened at PSU and WVU (and OSU), yet they all remain better at football (and basketball) should tell everyone how far Pitt really needs to go.

He claimed he was sexually abused as a child and that lead to his paralysis of action with Jerry.

As far as physical appearance he always looked oily and waxy.

My bad Hail I thought we were talking athletic scandals and I missed something.If your talking Heather Bresch Master Degree Scandal I don't think it's quite on the scale of Sandusky or MichiganState.You do know Heather is on the top 5 list of most hated people in Morgantown.Only her relatives like her,well some do!The people that work at Mylan(my son)want to stick her epi-pens where the sun doesn't shine!

Well, people keep voting for Manchin. It should be clear that he and his daughter are huge pieces of crap. People lost their jobs and those two got promotions. Very Clinton-like. It has to be a house of cards for those two, but if the people of West Virginia are stupid enough to vote for him again, then they deserve the further shenanigans coming their way.

Withstanding scandals is hardly admirable. Pitt might not be perfect but I'm okay if MSU or PSU type things never test us.

I agree that those scandals aren't admirable. But... those schools have withstood and bounced back from them. Pitt creates scandal like effects without actual scandals, and then takes longer to recover. It's amazing. Keeps happening too. The Stallings mess is unbelievable. Pretty much the same result as if Pitt had gotten nailed bigtime for cheating in basketball. Worse result, in fact. Once basketball starts to bounce back, then it will be football's turn again. They will come up with something. That's the real entertainment for Pitt fans now. I'm predicting that the Nike branding and logo study will result in something nobody wants. Again. Can't wait.

The attorney general that no one has ever heard of? Believe me Manchin isn't well liked, but GOP runs a bunch of jabronis. Noone will beat Joe. Just like Pennsyltucky has a bunch of goof voters as well. Noone cares or even heard of Bresch south of Rt 50. So Manchin will keep winning.

He has to win the primary AND general election. Most people in WV are stupid if Joe keeps winning, liked or not. But then again, most people in America are stupid, as they gave as Trump vs Hillary. We get what we deserve.

Okay. I get what you're saying but self inflicted stupidity versus criminal negligence are two different things.

I agree. I'd much rather have Pitt stink at something because of their self inflicted stupidity than stinking as a result of having sanctions imposed for allowing and then covering up heinous crimes.

Come on Perch man don't cut on John Raese his dad won the NIT for Wvu in 1942. At that time it was the basketball tournament in the country.I've known John since his very undistinguished softball playing career in Morgantown.Politics in WVA is "almost" as bad as they are in Pa!

In fairness to the Hoopies, I wouldn't even call the Heather Bresch MBA thing a "scandal". Someone of privilege and influence received preferential treatment....happens everywhere. And it sucks. But only reason this made the news was because someone in the press uncovered it and ran with it.

I am willing to bet having that MBA had zero to do with any of her career or financial success...it's all from the connections. They were probably more eager to give her the MBA than she was to have it, so they could show her off as a successful alum of the program. And I know people are coddled through "executive" MBA programs all over the country in similar fashion.

Hahaha, he didn't even live here when he was running. He was a Florida toolbag. I don't think the Libertarians ran a candidate in 2012 or I would have happily wasted my vote on him/her. I wont vote the Mountain Party. So I stayed home.
